I’m Arizona State Senator Sylvia Allen. I want to explain SB 1070 for which I voted yes. Rancher Robert Krentz was murdered by the drug cartel on his ranch a month ago. I participated in a senate hearing two weeks ago on the border violence, here are just some of the highlights from those who testified.

The people who live within 60 to 80 miles of the Arizona/Mexico Border have for years been terrorized and have pleaded for help to stop the daily invasion of humans who cross their property. One rancher testified that 300 to 1200 people a DAY come across his ranch vandalizing his property, stealing his vehicles and property, cutting down his fences, and leaving trash. In the last two years he has found 17 dead bodies and two Korans.

Another rancher testified that daily drugs are brought across his ranch in a military operation. A point man with a machine gun goes in front, 1/2 mile behind are the guards fully armed, 1/2 mile behind them are the drugs, behind the drugs 1/2 mile are more guards. These people are violent and they will kill anyone who gets in the way. This was not the only rancher we heard that day who talked about the drug trains. One man told of two illegals who came onto his property, one shot in the back and the other in the arm by the drug runners who had forced them to carry the drugs and then shot them.

Daily they listen to gunfire, during the night it is not safe to leave his family alone on the ranch and they can’t leave the ranch for fear of nothing being left when they come back.

The border patrol is not on the border. They have set up 60 miles away with check points that do nothing to stop the invasion. They are not allowed to use force in stopping anyone who is entering. They run around chasing them; if they get their hands on them, then they can take them back across the border. Federal prisons have over 35% illegals and 20% of Arizona prisons are filled with illegals. In the last few years 80% of our law enforcement that have been killed or wounded have been by an illegal.

The majority of people coming now are people we need to be worried about. The ranchers told us that they have seen a change in the people coming they are not just those who are looking for work and a better life.

The Federal Government has refused for years to do anything to help the border states. We have been overrun and once they are here we have the burden of funding state services that they use. Education costs have been over a billion dollars. The healthcare cost billions of dollars. Our State is broke, $3.5 billion deficit and we have many serious decisions to make. One is that we do not have the money to care for any who are not here legally. It has to stop.

The border can be secured. We have the technology and we have the ability to stop this invasion. We must know who is coming and they must come in an organized manner legally so that we can assimilate them into our population and protect the sovereignty of our country. We are a nation of laws. We have a responsibility to protect our citizens and to protect
the integrity of our country and the government which we live under.

I would give amnesty today to many, but here is the problem; we dare not do this until the Border is secure. It will do no good to give them amnesty because thousands will come behind them and we will be overrun to the point that there will no longer be the United States of America but a North American Union of open borders. I ask you, what form of government will we live under? How long will it be before we will be just like Mexico or any of the other Central American or South American countries?

We have already lost our language, everything must be printed in Spanish. We have already lost our history, it is no longer taught in our schools, and we have lost our borders.

The leftist media has distorted what SB 1070 will do. It is not going to set up a Nazi Germany . Are you kidding? The ACLU and the leftist courts will do everything to protect those who are here illegally, but it was an effort to try to stop illegals from setting up businesses, and employment, and receiving state services and give the ability to local law enforcement when there is probable cause, like a traffic stop, to determine if they are here legally. Federal law is very clear; if you are here on a visa you must have your papers on you at all times.

That is the law. In Arizona all you need to show you are a legal citizen is a driver license, MVD identification card, Native American Card, or a Military ID. This is what you need to vote or get a hunting license. So nothing new has been added to this law. No one is going to be stopped walking down the street. The Socialists who are in power in DC are angry because we dare try and do something.The Socialists wants us to just let them come. They want the "Transformation" to continue.

Maybe it is too late to save America . Maybe we are not worthy of freedom anymore. But as an elected official I must try to do what I can to protect our Constitutional Republic . Living in America is not a right just because you can walk across the border. Being an American is a responsibility and it comes by respecting and upholding the Constitution, the law of our land, which says what you must do to be a citizen of this country.

Anyone ever read Mexico's laws on illegal migrants?

I heard today the the head of ICE/INS has told Arizona can arrest all we want to but he doesn't have to accept them. So this is a federal department that refuses to act on a law on the books. Since when is law dependent on whim?

John W, the difference here is that once the "tide" turns, the LEGAL immigration system might actually become functional and able to keep pace.

NOTHING in the new legislation (at least that I've heard of or read) has ANY effect on those who are LEGAL immigrants.

I know you are going to think this is loony but.... what would happen if we actually paid a living wage to the people who kill the chickens and pick our food? is it possible folks here would take the jobs? Corporate farms have a good bit to do with the alien labor deal. Of course with Walmart and china teamed up importing more and more food this issue may just go away..

Dope... just make the damn stuff legal and get it over with. Like booze, laws against it are not going to stop folks from using.

Problem is there is just way too much money to be made with the current system on both issues and on both sides of the law.

We have to get past the notion that aliens only take jobs others won't. That's yet another stereotype. You can't tell me that legal citizensnad docummented immigrants won't take a job running a forklift, stocking inventory, filling orders, doing shipping and receiving. There was a raid here a few weeks ago at a warehouse and the vacancies created by those who's status was illegal, were quickly filled. That's more the norm.

Illegals are like anyone else. Get in at ground level and work. Get promoted. Make more money. There are many cases here where illegals who have been here a long time, are supervisors for citizens and documented immigrants. And they never take the time to get legal status. It's not questioned that these people work in most cases. My problem is that their whole premise of them being in those positions, above legal immigrants and citizens, is false.

I've said this before, if you're not Native American, you're either an immigrant or the decendent of one. My grandparents and step father obeyed our laws and came in legally. They melded into this country and became citizens and contributed to it. They never forgot where they came from. They never raised their old flag and desicrated the American flag.

Every country in Europe has strict immigration laws. Mexico has the worst I know of in North America. First violation of their laws puts you in a Mexican prison for 2 years. And there isn't an ACLU to argue on your behalf. Do it a second time and you're in for 10.

Oh I am sure the aliens will take better jobs no doubt is only human nature. But I think your point is a bigger bunch of propaganda that is if you are saying that is where the majority of aliens are working. It is my belief that most of them are in low paying jobs working in farming or meat processing plants. I know I see lots of Hispanics here in the south and I mean LOTS and you see them working labor type jobs.

The problem as I see it is we do not want to pay an extra 38 cents for a head of lettuce or a quart of strawberries or a chicken. So the cheap labor thing is not going away.

One thing I do not get is when walmart got busted with aliens locked in cleaning how come all you right wingers did not have a fit? actually I get it and the answer to my own question is in the above paragraph. Which also is the reason we no longer make diddly in this country.

By the way I really do not give a damn what they do down by the boarder let'em have at it. I do think they are ignoring the real problem with both the aliens and the dope.

1) Raise the wage to the federal minimum.
2) Threaten employers with prison for knowingly employing illegals, and ENFORCE IT!
3) We already have the mechanism to match Social Security numbers against biometric data. USE IT! Currently, all the illegals have to do is give an employer a valid SS# belonging to someone else (it happened to my number!). A reporter for KABC went onto the streets of LA a couple of years ago, and in ten minutes found several people who could put them in touch with others who could supply any kind of counterfeit papers - SS card, Green Card, Driver's License, even a US Passport. The quality depended on how much he wanted to pay. For $200 he got a SS card good enough to give an employer enough excuse to hire him. $2,000 bought a SS card, D/L and passport good enough to fool anyone but an expert.
4) Every time an able-bodied person registers for unemployment comp. beyond the first 3 months, offer him/her one of the vacancies created by 1,2 & 3 above. If they refuse, saying that it's beneath them, cut off unemployed comp., food stamps etc.

I've worked at the most menial jobs during college and when between jobs, and I'll bet most of you guys have.

Nick Jr. Even the "Native" Americans are immigrants. They came from Asia, as evidenced by anatomical features, such as high cheekbones. And the penalty for illegally entering Mexico is now a fine; jail was rescinded some months ago for a first offense. I don't know about a second. Frankly, any American who breaks into Mexico should be given psychiatric treatment, not jail.

And in any case, Mexico allows hundreds of thousands of "on-migrants" to enter from the south each year. People from Central- and South America, Asia, Africa and Europe, including countries sponsoring terrorism, are allowed to cross to the north to enter the US.

Nick that all seems fairly reasonable. your #2 is something that should have been done long ago 1 and 4 need a little more thought being my unemployment was more per week than I would make at min wage so some adjustment would be required one way or another.

This problem will never go away by simply gathering up aliens and sending them home or tossing dope merchants in prison. The source of the problem needs treatment or we have to change the laws until we get a situation we can live with. IMO the cheap labor deal is not going away, ever, the only thing that can go away to end it is the jobs or products they produce goes away to places like China.

The dope issues just are not going anywhere we just need to legalize it and figure out how to deal with a new problem set.

Oh and I am thinking Walmart owes me reparations for ruining this countries industry.

Illegal Alien Legal Challenge

Little noticed, last Friday the Obama administration yet again tried to make it easier for illegal aliens to stay in the United States. In a brief filed with the Supreme Court, the administration asked the court to carve out a special exemption for businesses who break the law by hiring illegal aliens.

In every state, individuals must have a business license to do a huge range of jobs, be it a restaurant, stores, salvage, selling cars, cleaning people’s houses, pest control, or other businesses. But people must get a criminal background check to get a license. Different states vary in terms of what crimes can disqualify one from getting a license — some including misdemeanors not covered in other states.

Similarly, if you commit a crime, your business license is very likely to be revoked. The same is true for professional licenses for lawyers, doctors, or even barbers. The logic for these rules is pretty strong. If someone commits a crime, states have decided those people can’t be trusted in dealing with consumers.

Both state and federal crimes are included in these criminal background checks, and it has always been up to the states to determine what crimes will bar people from being licensed. This is what the Obama administration now wants to change. The Obama administration wants crimes involving immigration violations specifically excluded from their licensing decisions.


When Obama’s Secretary of Homeland Security Janet Napolitano was Arizona’s governor back in 2007, she signed a law that added hiring illegal aliens to the list of crimes for which a business license could be revoked. Napolitano didn’t think that there were any legal problems with the law, and even defended it in court. Indeed, even the Ninth Circuit Federal Appeals Court — known for its left wing views — rejected challenges by illegal alien rights groups.

But the Obama administration has tried to rationalize its challenge to the Arizona law.

“Those provisions disrupt a careful balance that Congress struck nearly 25 years ago between two interests of the highest importance: ensuring that employers do not undermine enforcement of immigration laws by hiring unauthorized workers, while also ensuring that employers not discriminate against racial and ethnic minorities legally in the country,†Acting Solicitor General Neal Katyal wrote the Supreme Court. “There is no reason to believe that Congress intended a result that would subvert the purpose and operation of its general prohibition on state sanctions.â€

As states have always had the power to determine how criminal activity can cost people their business licenses, why didn’t the original Federal immigration law ban immigration law violations being considered?

But instead of guessing whether Congress “intended†such a result in 1986, there is a simple solution: Have Congress pass a law stating that immigration violations are the one crime that states must not consider for licensing. With massive overwhelming Democratic majorities in both the House and Senate, Democrats can do virtually anything that they want.

Part of the Obama administration’s motivation for this Supreme Court appeal is to create a legal precedent that only the Federal government can deal with immigration issues. They aim to use such a precedent to strike down the new Arizona immigration law that was just signed this year that allows local and state police to enforce Federal immigration law.

Asking courts to rewrite laws doesn’t show much respect for the rule of law. But maybe, despite massive Democratic majorities in both the House and Senate, the Obama administration knows that it doesn’t have the votes to pass such radical reform.

The problem with paying minimum wage and punishing employers is that :1. At least in Central California, farm workers are hired by legal Mexican-American contractors. They collect wages for workers and pay them. Often the workers are paid less than what was agreed upon or are outright robbed. The contractors drive around in new trucks and live in nice houses. The workers sometimes live in garages or farm labor camps that you wouldn't want to go within a mile of. They are disgusting. The farmers therefore have little or no contact with the workers so they have no idea as to whether they are legal or not.(O.k. they have a good idea!) but that's their story and they are sticking to it.

I have lived in California's central valley my whole life. In the summer it is not unusual for the temperature to be 100-110, and often higher than that. Farm workers die every year from the heat. It was only in the recent past that the farmers were required to provide porta potties. Before that, Nothing. I have picked peaches, cherries, apples, oranges, I have chopped cotton,(we grow more cotton here than anywhere else). I have pollinated fig trees, picked up olives and almonds, and worked in a packing house for two years (considered easy work,try it) Why do you think I went to college?

In the 1950's we had a program called the bracero program(sp.) Farm workers were allowed to work here legally and when crops were harvested they went home. While they were here they lived in railroad box cars. There was a camp about 1/2 mile from me. Although I don't believe people should have to live in box cars, the program made sense. Apparently our states are too stupid to reintroduce such a program.

Meaning no disrespect I have been amazed at the naitivety(S.p.) of those who live in the East and North. Where do you think your food comes from? We will see the full effect of policy change come harvest time. If you have to pay more for what you eat please do it with a smile. This is what you wanted.
As far as the drug trade coming across the border, I think we need to have the military on the border. Better here than in some country I really don't care about. If our soldiers/police see anyone coming across the boarder armed to the teeth. They should be shot no questions asked. But to be fair if we are going to police the southern border of the United States then we should also police the border with Canada. That includes the Alaska border.
We also need to stop emigration from Cuba. Political asylum you say? Are you aware that over 22,000 Mexican citizens have been murdered in their own homes? How many Cubans have been murdered. If Cubans are so unhappy with their government then let THEM overthrow it. But then, we wouldn't have any farm workers in Florida. Would we? Paul:)

Always remember that cuban immigration is more a political consideration that a human rights issue. No national politician wants to peeve the voters and risk losing Florida, unless they already know they won't win there. And it's been an easy way to "stand up to communism" without having to actually do much.

How is it political or standing up to communism when the rule is - if you make it here, and are not caught, you can stay,but, if your caught you must go back and try again. Maybe next time we won't catch you and you can stay! Perfect example is Elian Gonzalez. Remember him? He is now a hero in Cuba and living relatively high on the hog. If he had been allowed to stay in the U.S. would his life be better?

As far as voting is concerned Cubans cannot legally vote as the are not U.S. citizens. If they have become citizens then why would they want to go back to Cuba? Paul
