e-bay SCAM using Sunbeam Canada logo

Ladies and Gent,

It just came to my attention that a clock on e-bay using the Sunbeam Canada logo is up for bids. (item 300073565632)

This item is NOT endorsed by me NOR has this person gain persmission to produce this item.

It took me a great deal of time and energy to design this logo and thanks to Andrew Masse it came to fruition.

I believe in giving credit where credit is due... This guy is just greedy.

I urge you not to purchase this item and even contact this person advise his of this faux pas.

I have already sent him a message... no reply yet.

I know first hand how it feels to be knocked off. The sad thing is this clock is probably made in China (vomit). There is a toll free number that you can call connecting you to the bastards that are knocking you off. I would call them and say stop!! or pay royalty assuming it is copyrighted or registered somewhere. It is a great looking shield. Good luck with the fight.

Rick

p.s. I will not buy it.

Ohan: you have an inherent copyright in any original design, whether you register it or not, BUT you should either register or copyright it immediately, or you might find that someone else does it and you end up not being able to use it.

It happens to the biggest companies. When IBM introduced the Selectric single-element ("golf ball") typewriter in the mid-60s they were beaten to the punch in the UK by Remington, who registered the name first and later used Selectric for their electric shaver. IBM had to call their machine the "Model 72 single-element typwriter" - not exactly as catchy a name.

Hi Rick,

thanks for your support.

I did call the toll free number and advised them of my concern. The lady took my concerns and is forward it to her husband - who was not in.

I also sent a heads up to e-bay.

I designed this logo to give a unique and distinct look for the Canadian Rootes Group. I have not made a single cent from this logo nor from my website since it's creation five years ago. All expenses have out of my own pocket. I love doing what I do and enjoy my Sunbeam. I am merely trying to "keep the 'beam alive". (my saying by the way)

Ohan and group,

It is sad to have a thing like this happen, one of the biggest is that those crooks know it is from Ohans ideas, I have know Ohan for several years, he is way too nice of a concerned guy to get stabbed in the back by these inepts.

I beg all of you to start calling that number to protest and if able email the crap out of them. Load up their site with a bunch of junk mail as possible. But a big bad thing, is if you protest on their ebay thing, they will make it out like you are the bad one.

Really pees me off. Another thing is this, he is in Canada they are some where screwing every one that they can in the States.
Sorry to hear about that Ohan.

Hi Folks,

I am keeping my cool about this...This is the reply I got from this guy.

"Hi, Thank you for your email. They tell me here in my office you need an official email responce. Here it is! If you think puting a Sunbeam logo on top of a Maple Leaf makes it your design, I believe you will need a lesson in copy right law. I'm glad to remove the listing for you, and have already done so. I would pefer not to offer a clock that would limit the design to your club members, or Canadians in general. I appreicate you bringing this fact to my attention. Again, Thank you, Gerry"

Before I send him my reply, I like your input on this....

Also, correct me if I am wrong... My understand is it that Peugeot has the rights to "Rootes" and as long as Clubs and Groups are acting in good faith to keep the Rootes vehicles on the road, help promote club and community activities, they have no objections with us using or upgrading the logo.

If this is the case, then my design which stays true to the Rootes name was created for just that. Granted that it is unique and now that this person has taken this EXACT (and I mean exact mapleleaf, and Talbot) design and coupled it with a crappy product puts this clubs name under negative light. That is NOT what I have worked hard for in the past 5 years to establish. "Rootes Motors Group - Sunbeam Canada" has maintained a high standard and kept a positive foundation with various communities and will continue to do so and inferior products is one thing that I refuse to be associated with.

If anyone has a contact name at Peugeot, I would appreciate hearing from you as I would like to have this matter clarified.

There are many Sunbeam clubs out there that have modified the original logo to suit their clubs. This logo suits me and the group here in Canada.

>> Here is my two cents I sent to That crook.

To whom it may concern.

I saw a item on your ebay sales , I just want you to know that I am starting a campaign to complain about your company stealing an idea from a web site , Namely the Sunbeam Canada logo. The red maple leaf and words in the design were produced several years ago and are in our mind the logo for Sunbeam Canada.org.
I am asking you to remove your copies of this item from the ebay sales and to stop stealing ideas and plagiarizing said logos.

I was so impressed with Ohan's logo that I asked him to send me a club sticker which I am proudly displaying on my Alpine. (I'm Canadian) I'm also interested in the badge if they are produced. Thanks for keeping the beam alive in Canada Ohan.

Reading Gerry's reply, I get the impression he got out of the market because he wants to offer an item that appeals to a larger Alpine audience.

The copies..

Ladies and fellas, here is the last and latest item one the clock..
I will insert it here by permission of Ohan. My responce first. then his..

Jerry,
I just want to thank you for your response and action. The idea was not mine, it was a real hard working gentleman in Vancouver, B.C. He works as a local Mounty in that area. He also volunteers for many social projects. His current one is the run across the full of Canada, in order to raise money for the Make A Wish Program in Canada. Last year we were proud to help sponsor him for this item and he raised over 12,000 Canadian for the cause. In 2008 we hope to help out again and the goal is for 25,000.

As an added note he is looking for company sponsors, there may be hope yet..;=) If you are interested, his web page, www.Sunbeamcanada.org

Kind regards
Chuck Nicodemus, Clackamas, OR.

Gee I hope that ends it..
sorry to bore all but I had to doit. Ohan is way too nice of a guy.
Hi Chuck,

It's nice to know your name this time. I did finally realize with your help, that the red maple leaf in the background of your "CUSTOM" logo design had to do with Canada. Based on this, I agree this would be stupid to offer this design to anyone except Sunbeam owners in Canada. Please don't worry, I Will change the design at once. Are you all winners up there, are just you? If putting the "Sunbeam Logo" on a maple leaf was your big idea, (Golly, Gee Wis's), I was extremely impressed with all of the thought you put into your design. Did you also have to think many years about that concept for your design, or did it take your whole car club to figure this one out? I never really had any derogatory thoughts about our neighbors up north, but you jokers give a guy reason to think. Please fell free to advertise my web site any way you please, I would appreciate the additional business. Campaign Away, My Friend, Campaign Away!

Your Southern Buddy,
Gerry

How would you like it if we in the NW start a group called the crusinthefifties.com and sell items with your name/logo on them.

I enjoy he feels just cause to belittle Ohan's time in coming up with the logo. I'm sure it took less time to steal it!

It would not be so bad if the said seller of this fine time piece would donate fifty cents of every sale to the charity of your choice. He obviuosly has a factory in china that will recreate any logo at the drop of a hat. Instead of operating in a morally responsible manner he is just another greedy knock off specialists that hits the market fast and gets out when the fur flys. I'll bet that clock costs him $5.00 US on the dock (pure profit). These SOB's give Americans a bad name, unfornately it's a way of life for too many here in the states. The morally responsible Americans find themselves in the soup lines because of these jerks. And that's all I have to say about it. Sorry Jan I don't mean to get too negitive but this one boils the blood.

Now back to dreaming of the Alpine I'm am buying next week. AAAAH that's better!!!

Hi Rick,

I work as a Deputy Sheriff in Vancouver and day in and day out I see the slime of society get away with murder amongst other law violations. Needless to say I am jaded when it comes to the justice system here. What is the point in passing a law if no one is going to abide by it.

Laws are passed becasue of jerks like this guy. The more jerks the more laws. It's simple as that. Find me a law where it rewards good behaviour.

I am not going to stress over this but I am not going to let him get away with it either.

Even if he offerd to give a percentage to charity, i would not accept it because it is dirty money. The best thing we can do is NOT buy his junk.

Honesty is my best policy.

Hi Gang!
I produced the computer graphics work for Ohan and it makes me very %$!@$#@$ mad. Sure, he pulled the clock off of ebay but he is still selling the graphic/clock on his web site.
Just to let you know Ohan, I gave him an email in hope that it might put a stop to its sale! I will also call him on Monday and I will let you know what he has to say!

I had the pleasure of seeing the Targa last night on TV! Wow, it was a great show and your car looked fantastic. I have watched the show every year and this year was the best yet! I will have to see what I can do for the Targa in 2008!

P.S. I love to help the car clubs when ever possible but I will not help people who just wish to line their pockets with money or who do not understand the word copyright!

As soon as a thought is written or a line is drawn there is an automatic copyright on the work. That is why one should always change or customize their artwork and make it original. It is the same as writing a book or composing a song, some songs may sound similar or the inference to a paragraph may be similar but they had better be different for fear of copyright infringement. The most frustrating thing for me is the use of material without consent not to mention another party making good from your efforts. I don’t have a problem if the guy was to produce his own artwork and use it for his clock face, but this is a copy of the artwork that Ohan put together, the linework is exact! The Lion, Crown, hat and background of our logo is reminiscent to the original Talbot logo but it is a new design and it has a copyright! Ohan and I are not looking to profit off of “our work†yet this guy is! I would think anyone would be a little put off by this fellow! This fellow has a copyright on his web site, so what is that?
